I have found this article http://www.contactmusic.com/news.nsf/story/japanese-court-rules-pre-1953-movies-in-public-domain_1002318
which points towards a ruling of pre-1953 films produced in Japan to be Public Domain

In addition, two further articles clarify the court ruling which disclude 10 pre-1952 Kurosawa films from Public Domain

I am enquiring about Archive.org's position for hosting Pre-1953 Japanese films since there seems to be scarcely any up here.

I hope that Video-Cellar will comment on this.

Can you list some good pre-1953 Japanese movies that we should try to obtain?

One of my favorite Japanese films (not pre-1953) is the samurai move "Hara Kiri". Has anyone else seen it?

I would recommend anything by Yasujiro Ozu, he is a good Kurosawa precursor and is considered one of the great Japanese directors

Does anyone have any pre-1953 Japanese cartoons?

The consensus on Japanese copyright is that all Japanese films made before 1971 are covered by a director post mortem calculation (where they enter the public domain at the beginning of the 38th year after the death of the author) and all films made from 1971-2004fall into the public domain at the beginning of the 51st year after publication (and 71 years for those made 2004 onwards). Some argue that the 2004 20 year extension applies to all movies from 1971 onwards but this has not been tesetd yet. In a strange legal anomaly, Japanese law treats all films from other countries under the 1971 laws regardless of when they were made.

Note that in the US there is no rule of the shorter term so films that were not public domain in the US and Japan in 1995 are not public domain in the US. Also note that Japanese films that have entered the public domain since 1996 do not eneter the US PD until their full US term has passed (95 years from publication.)

The animated japanese film "Panda and Magic Serpent" has been released by some PD distributors. Is it really PD?

I have stated clearly that the court EXCLUDED KUROSAWA FILMS FROM PUBLIC DOMAIN. I am curious about archive.org's stance on ALL OTHER PRE-1953 FILMS.
